Notice and Consent to the Processing of Personal Data
Pursuant to and in accordance with Article 13 of Legislative Decree 196/2003, concerning the personal data provided to Whisky Italy S.r.l.s. and which will be subject to processing, the interested party is hereby informed as follows:
The personal data collected on the website http://www.whiskyitaly.it by the company Whisky Italy S.r.l.s. are exclusively those voluntarily provided by the interested party in the areas specified below.
Our Company, Whisky Italy S.r.l.s., the Data Controller as well as the owner of the website http://www.whiskyitaly.it, hereby informs you of the following and invites you to carefully review the content of this document BEFORE providing any data.
The interested party is free to provide or not provide their personal data, but providing them may be mandatory under the law, regulations, and community directives, or based on provisions issued by competent authorities.
Refusal to provide personal data may result in the inability to use the services of Whisky Italy, to establish new relationships, conclude contracts, place orders, or engage in any commercial or non-commercial relationship with our company. Specific and prior consent is requested by the Data Controller, through electronic means, before placing any order, entering into a contract, or subscribing to the offered services. Minors are prohibited from placing orders for alcoholic beverages.
1) Data Controller
The Data Controller is the company Whisky Italy S.r.l.s., headquartered in Rome, Via dei Rangoni n. 64, 00148, Italy, Tax Code 12498331003, email info@whiskyitaly.it, represented by the Legal Representative, engaged in the wholesale and retail trade of liquors and alcoholic beverages through websites (e-commerce) and/or other distribution and sales channels deemed appropriate. The company is also involved in event organization, tastings, and marketing consultancy.
2) Data Processing Managers and Officers
(Article 13, Paragraph 1, letters (d) and (f) of the Code and point 9 of the Recommendation)
The person responsible for processing personal data, including responses to the data subject, carried out as part of their activities and for the purposes indicated in chapters 4 and 5, is the Legal Representative, who can be contacted at the Data Controller's contact details (see Chapter 1), through paper and electronic communications (via the email info@whiskyitaly.it).
External Data Processors: The Data Controller, Whisky Italy S.r.l.s., has appointed several external Data Processors who carry out delegated or ancillary processing for the sole purpose of better achieving the objectives (see Chapters 4 and 5). The Data Controller may employ other professionals/consulting firms, subject to their appointment as data processors/officers. Among the external processors are any System Administrators. The updated list of data processors is provided to the data subject in writing or verbally upon their request to the Data Controller by phone, letter, or email at the contacts listed above (see Chapter 1). The data processing officers include our staff/employees with secretarial, administrative, and accounting functions, as well as any collaborators.
Whisky Italy S.r.l.s. will not disclose user data to third parties for promotional activities or for purposes that fall outside the scope for which the data were collected.
3) Data Processing Methods
Processing is carried out through any operation or set of operations among those indicated in Article 4, Paragraph 1 of Legislative Decree 196/2003, using both manual and electronic tools. The data provided will be stored on magnetic or paper supports, always in compliance with the security requirements established by law, and may be disclosed to the company’s employees, consultants, and external legal advisors responsible for processing aspects relevant to them, as well as for the administrative and fiscal management of the relationship. Whisky Italy S.r.l.s. undertakes not to use data identified as inaccurate until the inaccuracy has been corrected.
4) Purpose of Data Processing
The personal data, both common and sensitive, will be processed and used for service management, specifically:
- For the purchase of our products or to conclude contracts, place orders, and manage any commercial or non-commercial relationships.
- With the user’s explicit authorization, for sending Mailing Lists or Newsletters that Whisky Italy S.r.l.s. uses to keep its customers and users updated on services and initiatives of the website http://www.whiskyitaly.it.
- With the user’s explicit authorization, for sending information to the data subject regarding activities and initiatives of Whisky Italy S.r.l.s.
- With the user’s explicit authorization, for sending informational or advertising material to the data subject, including interactive commercial communications.
- To carry out activities aimed at the sale or placement of goods or services.
- For the development of studies and statistical research on sales, customers, and other information, as well as marketing activities.
The data provided will be processed and stored by Whisky Italy S.r.l.s. in accordance with current regulations for the aforementioned purposes and for any future relationships that may be established unless the data subject explicitly revokes authorization for processing.
5) Data Disclosure and Transfer Abroad
The personal data provided will not be disclosed and may be transferred abroad (but within the EU country).
6) Rights of the Data Subject
(Article 7 of Legislative Decree 196/2003)
Whisky Italy S.r.l.s. grants the data subject the right to:
- Obtain confirmation of the existence or non-existence of personal data concerning them, even if not yet recorded, and to receive such data in an intelligible form;
- Obtain information regarding the origin of the personal data;
- Obtain information on the purposes and methods of processing;
- Obtain information on the logic applied in the case of processing carried out with the aid of electronic tools;
- Obtain information on the identification details of the data controller, the data processor, and their representative as per Article 5, Paragraph 2 of Legislative Decree 196/2003;
- Obtain information on the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them as a representative, data processor, or data processor officer;
- Obtain the updating, rectification, or, when there is interest, integration of the data;
- Obtain the deletion, transformation into anonymous form, or blocking of data processed in violation of the law, including those for which conservation is unnecessary for the purposes for which the data were collected or subsequently processed;
- Obtain certification that the operations mentioned in the preceding two paragraphs have been brought to the attention of those to whom the data have been communicated or disseminated, except in cases where this requirement proves impossible or involves the use of means that are manifestly disproportionate to the protected right;
- Object, in whole or in part, on legitimate grounds, to the processing of personal data concerning them, even if pertinent to the purpose of collection;
- Object to the processing of personal data concerning them for the purpose of sending advertising material or direct sales, or for carrying out market research or commercial communication.
The provided data may be verified upon request and can be updated and/or corrected by sending a letter or fax, as well as by email to the following address: info@whiskyitaly.it. Through the same means, the deletion of the provided personal data can be requested.
If the deletion of provided personal data is requested, Whisky Italy S.r.l.s. will promptly proceed with the deletion without further notice and/or communication. Such deletion, if the deleted data are necessary for the services provided or for established relationships, may result in the immediate termination of those services or relationships.
